Nevada State Assembly Passes Reforms to Eminent Domain Law
Las Vegas real estate owners will rest easier if a bill, passed today by the Nevada Assembly, is adopted. The bill in question would require stricter standards for local governments to be able to invoke eminent domain and seize private property for redevelopment. As reported by KRNV news in Reno, under existing law, local governments only need to have the property classified as a “blight.” The law currently set to be deliberated in the Senate would require that the property also meet additional criteria. The proposed measure would further require that the redevelopment agency present the owner with an offer before asking the local government to become involved.Considering the shortage of undeveloped properties in the Las Vegas area right now, eminent domain may become an increasingly prominent issue in the near future. If the bill is approved by the Nevada Senate and becomes law, property owners in Las Vegas and Clark County would be the most obvious beneficiaries, gaining additional protection for their property against government seizure.
